Terms

The agreement between BlackStar Orbital and anyone who uses this site, buys from the Quartermaster, or flies a payload on the BX-100. Written to be read, not endured.

Effective 01 Jul 2026 Version REV 04 Governing law State of Florida, USA

The short version

Plain language · not a substitute for the terms below
01

Use the site fairly.

Read, share, and quote it. Don't scrape it, break it, or pass our marks off as your own.

02

Flights are contracted.

Nothing here is a launch contract. Missions fly under a signed Launch Services Agreement.

03

Store goods are final-ish.

30 days to return unworn kit. Numbered and flown items are final sale.

04

Schedules move.

Spaceflight slips. Dates are targets, and we tell you early when they change.

Clause 01

Acceptance of terms

By accessing blackstarorbital.com, ordering from the Quartermaster, or entering into discussions about flying a payload on the BX-100, you agree to these terms. If you're agreeing on behalf of an organization, you confirm you have the authority to bind it.

If you don't agree, please don't use the site. That's the whole clause.

Clause 02

Use of this site

This site is published for information. You may read it, link to it, and quote it with attribution. You may not:

  • Scrape, mirror, or bulk-download the site or its imagery for commercial reuse.
  • Attempt to access systems, endpoints, or data not intentionally made public.
  • Represent BlackStar Orbital, its vehicles, or its programs in a way that implies partnership or endorsement we haven't given.
  • Use the site in violation of any applicable law, including export-control regulations.

Vehicle specifications, mission profiles, and pricing shown on this site are indicative and describe design intent for a vehicle in qualification. They are not warranties of performance.

Clause 03

Launch services

Booking tools, price estimates, and mission configurators on this site produce non-binding estimates only. Submitting a reservation request starts a conversation — it does not reserve a slot, form a contract, or create any obligation on either side.

All flights are conducted under a separately negotiated and executed Launch Services Agreement ("LSA") covering payload requirements, integration, insurance, licensing, liability allocation, and schedule. Where these terms conflict with an executed LSA, the LSA governs.

Schedule reality

Launch dates are targets, not promises. Weather, range availability, regulatory approvals, and vehicle readiness all move schedules. We commit to telling you as early as we know — not to a date we can't hold.

Payload eligibility

All payloads are subject to safety review, regulatory approval, and range acceptance. We reserve the right to decline any payload that presents an unacceptable safety, legal, or reputational risk, at any point before flight.

Clause 04

Quartermaster orders

Orders placed through the Quartermaster are subject to availability. Items are produced in numbered runs and ship in the order reserved; typical domestic delivery is two to three weeks from the close of a run.

Returns

  • Standard kit — unworn, unwashed, with tags: 30 days from delivery for a full refund.
  • Numbered and made-to-order items — final sale, except where faulty.
  • Flown hardware — final sale in all cases. See clause 05.

Faulty goods are replaced or refunded at our cost, always. Prices are shown in USD and exclude taxes and duties, which are the buyer's responsibility. International orders ship at cost.

Clause 05

Flown hardware & provenance

Because the BX-100 returns to a runway, a small share of retired flight components is documented and issued through the Quartermaster. Each flown item ships with a signed certificate tying it to a specific mission and airframe.

We warrant that flown items are genuine hardware that flew the mission stated on the certificate. We make no representation as to future collectible value, and flown items carry no functional warranty — they are artifacts, not parts. Resale is permitted; transfer of the certificate is the buyer's responsibility.

Clause 06

Export control

BlackStar Orbital is a United States launch provider. Our vehicles, technical data, and services are subject to U.S. export-control law, including the International Traffic in Arms Regulations (ITAR) and the Export Administration Regulations (EAR).

Technical discussions, payload integration data, and certain hardware may not be shared with foreign persons or entities without appropriate authorization. By contacting us about a mission, you agree to disclose the nationality and ownership structure of your organization so we can determine what may lawfully be discussed.

Please note

Do not send technical data, drawings, or payload specifications by email before an export-control review is complete. We'll tell you when there's a cleared channel.

Clause 07

Intellectual property

The BlackStar Orbital name, the BlackStar mark, "BX-100", vehicle designs, program imagery, and the contents of this site are our intellectual property or that of our licensors.

Press and media may reproduce imagery and text from our press kit for editorial coverage, with attribution and without modification to the vehicle's depiction. All other use — including commercial, promotional, or AI-training use — requires written permission.

Clause 08

Privacy & data

We collect only what we need to reply to you and fulfil orders: the contact details you submit, order and shipping information, and basic, aggregated analytics about site usage.

  • We do not sell personal data. Ever.
  • Payment details are handled by our payment processor and never stored on our systems.
  • Mission enquiry data may be shared with regulators and range partners where required for licensing and safety review.
  • You may request a copy or deletion of your data at any time — write to us and we'll action it within 30 days.
Clause 09

Disclaimers & limitation of liability

This site is provided "as is". We work to keep it accurate and current, but we do not warrant that it is free of errors or that specifications shown reflect the final qualified vehicle.

To the maximum extent permitted by law, BlackStar Orbital is not liable for indirect, incidental, or consequential damages arising from use of this site or reliance on information published here. Liability arising from an executed Launch Services Agreement or a Quartermaster order is governed by that agreement or, for goods, capped at the amount paid for the item.

Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence.

Clause 10

Changes & contact

We may revise these terms as the program matures. Material changes will be posted here with an updated effective date and revision number; continued use of the site after that date constitutes acceptance.

These terms are governed by the laws of the State of Florida, USA, and the courts of Brevard County have exclusive jurisdiction.
